The consumer may request, at their choice, that the goods be repaired or replaced, free of charge in both cases, unless the requested remedy is impossible or would impose disproportionate costs on the seller.
The consumer is entitled to a proportional price reduction or termination of the sales contract, in accordance with Article 135-bis, paragraph 4 of the Italian Consumer Code, and in particular if:
the seller has not carried out the repair or replacement within the terms and conditions provided for by the Consumer Code, or has refused to bring the goods into conformity;
the lack of conformity is so serious as to justify the immediate reduction of the price or termination of the contract;
a lack of conformity appears despite the seller’s attempt to restore the conformity of the goods;
the seller has declared (or it is clear from the circumstances) that they will not restore the conformity of the goods within a reasonable period of time or without inconvenience.
The consumer is not entitled to terminate the contract if the lack of conformity is only minor.
Defects or damage resulting from accidental events or from the consumer’s responsibility for use of the products not in accordance with their intended purpose, or as a result of normal wear and tear, are excluded from the lack of conformity and therefore from the legal warranty.
The warranty applies to the product that presents conformity defects and/or malfunctions not detectable at the time of purchase, provided that the product is used correctly and with due diligence, namely in compliance with its intended use and with any provisions set out in the relevant technical documentation.
Repair interventions during the warranty period are carried out through Service Centers authorized by the individual manufacturers. Transportation costs relating to the shipment for repair and the return of the repaired product shall be borne by the consumer, unless otherwise specified in the warranty policies of the specific manufacturer.
If, following intervention by an authorized Service Center, the problem is found NOT to be a conformity defect covered by warranty, the consumer will be charged for the costs of testing, inspection, and restoration, if applicable, as provided by the authorized Service Center.
In the event that, for any reason, the Service Center is unable to return to the consumer a product under warranty (repaired or replaced), it will be at our discretion to refund the full amount paid or replace it with a product of equal or superior features.
No compensation may be claimed for any delays in carrying out repairs or replacements.
